Michael Jordan Tells Court He Felt No Fear of Nascar in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer motivated his effort with 23XI Racing to confront Nascar over alleged violations of competition laws.

Financial Stakes and a Competitive Drive

Jordan shared financial and corporate details of his 23XI team, saying he put in $40m of his own funds into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.

“It fell to someone to act,” Jordan stated during testimony. “I was a new person, I had no fear. I felt I could challenge Nascar as a whole. I felt as far as the sport it needed to be looked at from a different view.”

Central Issue: Franchise System and Renewal Demands

At issue is the expiration of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other professional sports with separately owned franchises, such as the NBA’s Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar demanded teams renew their charters.

She said, Joe Gibbs first tried to call and talk Nascar out of forcing signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Gibbs recounted was the message to Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
